A civil lawsuit filed today, accuses the insurance company of paying the wrong person, Betsy’s friend Pam Hupp. Betsy reportedly changed the life insurance beneficiary from her husband to Hupp, four days before the murder.
The suit says that change form was not imaged by State Farm until the day after Betsy’s death, making it incomplete.
State Farm paid the policy proceeds to Hupp.
Russ’ attorney, Bevis Schock, also alleges that the insurance company had no right to rely on information from the Lincoln County Prosecuting Attorney that Hupp was not a suspect, when it paid her.
Earlier this year, Pam Hupp successfully fought off a civil lawsuit filed by Betsy’s daughters for the $150,000.
