RIVERSIDE, CA  – A 12-year-old boy has been charged with killing his neo-Nazi father.  Reuters News says prosecutors have rested their case but the defense in the trial says he may testify on his own behalf.

His father, Jeffrey Hall was the director of a neo Nazi organization.  He was asleep on the couch in May w2011 when his sun shot him with a loaded .357 Magnum revolver gun.

The defense says that Joseph Hall shot his father at point blank range when he was just 10 years old.  The shot killed his 32 year old father.  They say he should not be held criminaly responsible.

The LA Times reports that mental health experts at the trial point to Joseph Hall’s “tragic history”.  They say he has been subjected to violence since being a toddler.  But, a child psychologist at the trial says that there was no indication that the boy’s father condoned such brutality.

According to testimony at the trial the defendant’s past violent acts include trying to strangle a teacher and stabbing classmates with pencils.

If the 12-year-old defendant does not testify then both sides will hear closing arguements on Wednesday.
