EDWARDSVILLE, IL (KTVI)– The Illinois Supreme Court has refused to consider an appeal from the Madison County State’s Attorney’s Office.

That office was appealing an appeals court decision to throw out the conviction of Southern Illinois University-Edwardsville student Olutosin Oduwole.

A Madison County jury had convicted Oduwole of making a terrorist threat.

Prosecutors say he wrote threatening lyrics just months after the Virginia Tech massacre and had a handgun and had ordered four other guns.

Oduwole argued the lyrics were nothing more than that and not a real threat of violence.
