CHARLOTTESVILLE, Va. (AP) _ Five former members of the University of Virginia men’s swim team are asking a judge to dismiss a hazing lawsuit filed in federal court by an ex-teammate.
The civil action was filed in June by Anthony Marcantonio against the former team members. He cited a series of events that allegedly occurred during the team’s “Welcome Week” in August 2014.
A September 2016 trial date has been scheduled.
The Daily Progress reports that Marcantonio says he and other first-year swimmers were taunted and threatened into forced drinking of alcohol, sexual contact and the consumption of live fish.
Marcantonio has since transferred to Northwestern University.
In their motion to dismiss, the five argue that Marcantonio fails to provide sufficient facts to support his allegations of assault, false imprisonment and hazing.
